2. The appellants are apprehending their arrest in a case registered for the offence punishable under Sections 147, 341, 323, 504, 506, 379, 427 of the Indian Penal Code and Sections 3(i)(R)(s) of the SC/ST Act.

3. After some argument, learned counsel for the appellants seeks permission to withdraw this appeal.

4. Permission is granted.

5. Accordingly, this appeal is dismissed as withdrawn.

6. However, if the appellants surrender before the learned court below within a period of six weeks from today and

Patna High Court CR. APP (SJ) No.2250 of 2023(4) dt.20-12-2023 2/2 pray for regular bail, the same shall be considered by the learned court below on the same day without being prejudiced by this order considering the fact that the appellants are senior citizen aged about 84 and 79 years and they have no criminal antecedent.
