JUSTICE PURNENDU SINGH ORAL ORDER 01-07-2024 Heard Mr. Gaurav Govind, learned counsel appearing on behalf of the petitioner and Mr. Rajeshwar Singh, learned G.A. 10 along with Mr. Manoj Kumar Yadav, A.C. to G.A. 10 appearing on behalf of the State and Mr. Ram Hriday Prasad, learned counsel for the respondent.

2. Learned counsel appearing on behalf of the State informs that the Advertisement was of the year 2004 and the panel was kept pending and after much delay and the counseling was conducted in the year 2012. The petitioner had not appeared in the said counseling and has waved his right. The learned

Patna High Court CWJC No.22956 of 2012(4) dt.01-07-2024 2/2 counsel submitted that in this regard specific statement has been made in paragraph no. 4 and 5 of the counter affidavit, which are reproduced hereinafter:- "4. That it is humbly stated that in compliance of the order dated 08.06.2011 passed in L.P.A. No. 831/2009, the Commandant B.M.P. 8, Begusarai, respondent no. 4 was made the Chairman of the Constable Selection Board, Military Police (North Division) for fulfilling the remaining vacancy of the post of Constable arising from Advertisement No. 2/2004.

5. That it is further stated that petitioner does not deserve any relief to be granted by this Hon'ble Court on the ground that the petitioner failed to appear on the ground that the petitioner failed to appear on the date fixed for counseling on 05.07.2012 and the candidates were intimated about the counseling date vide notice on Board dated 15.06.2012 and through advertisement published in the daily newspaper Hindustan on 22.06.2012 as well as in Dainik Jagran on 23.06.2012 whose circulation is in the every corner of the State. The petitioner belongs to B.C. II Category and his Roll No. 23477 figured in the said advertisement list."

3. Considering the fact that the process of selection has already been completed, I do not find it proper to interfere in any manner to grant relief to the petitioner, as prayed for in the present writ petition.

4. Accordingly, the present writ petition stands disposed of.
