2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 309(4) read with Section 3(5) of the Bharatiya Nyaya Sanhita.

3. The case of the prosecution is that on 25.01.2025 at about 12:23 PM, the informant was carrying Rs.3,23,090/- in a red colour bag along with some papers relating to transaction of business. It is alleged that four persons from two bikes having masked their face, overtook him and snatched the bag containing cash from the informant and escaped with the money along with the key of scooty.

4. Learned counsel for the petitioner submits that the name of this petitioner has surfaced in the confessional statement of co-accused Dharmendra Kumar and Golu Kumar. The FIR

Patna High Court CR. MISC. No.31639 of 2025(2) dt.21-05-2025 2/2 was lodged against unknown miscreants. It has also been submitted that noting has been recovered from the possession of this petitioner. Learned counsel further submits that co-accused Golu Kumar from whose possession Rs.30,000/- was recovered has been granted bail by this Court vide Cr. Misc. Case No.30922 of 2025. The case of this petitioner stands on better footing. The petitioner is having no criminal antecedent and is in judicial custody since 25.02.2025.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kadirganj P.S. Case No. 31 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada.
