2. The petitioners seek bail in connection with Basantipur P.S. Case No. 61 of 2024 dated 16.02.2024 registered for the offences punishable under Sections 286, 307/34 of the I.P.C. and Section 3⁄4 of the Explosive Substance Act.

3. As per the prosecution case, the petitioners and coaccused persons are alleged to have thrown bomb on the informant's three grandsons causing severe injuries.

4. Learned counsel for the petitioners has submitted

Patna High Court CR. MISC. No.33243 of 2024(2) dt.08-05-2024 2/3 that the petitioners are innocent and have falsely been implicated in this case. It is submitted that there is no eyewitness to the said occurrence and the petitioners were only seen fleeing away from the place of occurrence. From Annexures 2 and 3 which are injury reports of the grandsons of the informant, it is evident that one Rajnish Kumar has received (i) abrasion wound, right leg of calf muscle size 2x1/2, (ii) abrasion wound left leg of ankle size 1 1/2" simple in nature. Annexure-3 is the injury report of Shani Kumar which shows that he received (i) burn in right foot (superficial skin) size 3 x 1/4th, (ii) burn in right foot (superficial skin) size 3 x 1/4th. One another victim, Sonu Kumar is also said to have received superficial injury. Learned counsel further submits that the petitioners have got clean antecedent, as stated in paragraph no. 3 of the bail petition. They are in custody in this case since 17.02.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody along with simple injuries are said to have been received by the victims, the petitioners, above named, are directed to be enlarged on bail on

Patna High Court CR. MISC. No.33243 of 2024(2) dt.08-05-2024 3/3 furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Siwan in connection with Basantipur P.S. Case No. 61 of 2024.
