1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 103(1), 352, 351(2) and 3(5) of the BNS as well as Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 04.01.2025 and the informant alleges that his sister was married with the petitioner in the year 2021. Further, after marriage, the accused persons including the petitioner started demanding dowry and on non-fulfillment of the same, the victim was meted with cruelty. It is next alleged that on 03.01.2025, the informant received a call that his sister was ill, accordingly, he went to the place of occurrence and found the
Patna High Court CR. MISC. No.29561 of 2025(3) dt.06-08-2025 2/3 dead body of his sister having ligature mark on the neck. Further, on inquiry, the accused replied that the deceased committed suicide.
4. Learned counsel for the petitioner submits that petitioner being the husband of the deceased has been falsely implicated in the instant case by the informant. It is further submitted that all deaths are not dowry deaths and even from perusal of the allegation as alleged in the FIR, it would manifest that the allegation of demand of dowry is general and omnibus in nature. It is next submitted that no efforts were made by the petitioner or his family members to dispose of the dead body with a view to conceal the evidence which amply demonstrates that the petitioner and his family members were not involved in the occurrence and the Doctor opined that death was caused on account of asphyxia due to hanging.
5. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner and submits that petitioner is the husband. The death took place in the matrimonial home. The presumption in law is against the petitioner.
6. Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to release the
Patna High Court CR. MISC. No.29561 of 2025(3) dt.06-08-2025 3/3 petitioner on bail in connection with Bhabua P.S. Case No. 05 of 2025 pending in the Court of learned Chief Judicial Magistrate, Kaimur at Bhabua/Successor Court.
7. Hence, the prayer for bail is rejected.
