2. The petitioner seeks bail in connection with Siwan Muffasil P. S. Case No. 82 of 2025, dated 06-02-2025 instituted for the offence punishable under Sections 126(2), 115(2), 117(2), 109, 103(1), 352 and 3(5) of the Bharatiya Nyaya Sanhita 2023.

The prosecution case, in short, is that on 06.02.2025, around 6:30 PM, while the informant and his family were returning after immersing the idol of Goddess Saraswati, they were stopped, abused, and assaulted at Aghaila Pokhra Kali Mandir by the accused persons named in the FIR, including the petitioner and 35-40 unknown persons who were armed with various weapons. Patna High Court CR. MISC. No.29503 of 2025(2) dt.15-05-2025 2/3 alleged that co-accused Balister Sah assaulted the informant's father on the head with an iron rod, due to which he died on the spot. The informant, his brother Mukesh Yadav, grandfather, and cousin Rakesh Kumar were also assaulted. The occurrence arose from a dispute over playing of vulgar song, which resulted in the filing of this case.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. There is no specific allegation against the petitioner; rather, the accusation against him is general and omnibus in nature. It is submitted that there is a specific allegation against co-accused Balister Sah, who assaulted the informant's father on the head with an iron rod. In the said assault, three other persons were also injured. It is further submitted that similarly situated co-accused persons, namely Satyendra Singh and Umesh Singh, have been granted regular bail by a co-ordinate Bench of this Court vide order dated 07.05.2025 passed in Cr. Misc. No. 28702 of 2025. The petitioner has been in judicial custody since 07.02.2025 and has no criminal antecedents. The charge sheet has already been submitted in this case.
5. Learned A.P.P. has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Siwan, in connection with Siwan Muffasil P. S. Case No. 82 of 2025.
7. The application stands allowed.
