Learned counsel appearing for the petitioner submits that the petitioner has filed the present writ petition for the following relief/s :- "For the issuance of writ in the nature of certiorari or any other appropriate writ to quash the final merit list of home guard of different blocks of district of Munger, prepared against advertisement no. 02/2011. The final merit list is illegal having been prepared at Block level even though it had to be prepared at district level.

Patna High Court CWJC No.7128 of 2026 dt.11-05-2026 2/3 (ii) For the issuance of writ in the nature of mandamus or any other appropriate writ to command the respondents to publish the final result of home guard admission against advertisement no. 02/2011 at district level and not block level and thereafter to appoint the petitioner, as he had successfully qualified the selection process conducted by the respondent against advertisement no. 02/2011 for recruitment of Home Guard.

(iii) For the issuance of writ in the nature of mandamus or any other appropriate writ to command the respondents to fill up all the remaining vacant seats of Home Guards in the district of Munger arising from the year 2011 till 2023 due to death, resignation, removal etc, from petitioner and remaining successful candidates of physical test of High Jump, long Jump, shot put test, who have also been found fit in physical measurement and medical in all the blocks of district Munger against the advertisement no. 02/2011.

(iv) For any other direction, which your lordship may deem and proper in the facts and circumstances of the case."

Learned counsel for the State has raised a preliminary objection and submits that the relief sought by the petitioner cannot be granted, inasmuch as the issue involved in the present writ petition is similar to that involved in CWJC No. 11645 of 2019. He further submits that the said judgment was

Patna High Court CWJC No.7128 of 2026 dt.11-05-2026 3/3 assailed and tested in LPA No. 645 of 2021 and thereafter before the Hon'ble Supreme Court in SLP No. 21079 of 2024.

4. Learned counsel further submits that from the order passed in the LPA, it is evident that the relief granted by the learned Single Judge was confined only to the two writ petitioners of CWJC No. 11645 of 2019 and was not intended to be extended universally to all similarly situated persons.

5. In the aforesaid background, this Court does not find any merit in the present writ petition.

6. Accordingly, the present writ petition stands dismissed.
