JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-08-2021 Heard learned counsel for the petitioner and learned counsel for the State via video conferencing. The petitioner has renewed his prayer for bail in connection with Derni P.S. Case No. 214 of 2019 registered under Sections 30 and 30(a) of the Bihar Prohibition and Excise Act, 2016. His prayer for bail was earlier rejected by this Court vide order dated 13.05.2020 on the ground that 820 liters of Indian-made foreign liquor was recovered from his house. Learned counsel for the petitioner submitted that the petitioner has remained in custody for nineteen months and there is no likelihood of the trial coming to an end in near future. He submitted that till date charges have not been framed. Learned counsel for the State has opposed the prayer for grant of bail to the petitioner.

No.32737 of 2020(3) dt.11-08-2021 2/2 Considering the nature of the offence, the period of nineteen months undergone by the petitioner in custody and the unlikelihood of the trial to be concluded in near future, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd A.D.J.- cum-Special Judge, Excise, Saran at Chapra in connection with Derni P.S. Case No.214 of 2019.
