JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-07-2025 The present petition is by way of fourth attempt at the behest of the petitioner for grant of bail in connection with Session Trial No. 150 of 2021, arising out of Sigori P.S. Case No. 94 of 2019, registered for the offences punishable under Sections 307, 341, 323, 324, 504 and 34 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was added, inasmuch all the earlier petitions filed by the petitioner for grant of bail have stood rejected.

This Court, vide earlier order dated 9.5.2025, had called for a report from the learned Trial Court with regard to the present stage of the trial and the time likely to be undertaken for conclusion of the same, in pursuance whereof, a letter dated

No.31402 of 2025(5) dt.04-07-2025 2/3 21.5.2025 has been sent by the learned Court of Additional Sessions Judge-V, Civil Court-Danapur, Patna, wherein it has been stated that four witnesses have already been examined and as far as the fifth witness, Dr. Sabbir Ahmad Chaudhary, is concerned, date has been fixed for 24.05.2025 for his crossexamination, hence the trial is likely to be concluded within a period of four months.

In view of the aforesaid, though the learned Senior Counsel for the petitioner does not seek to press the present petition at the moment, however seeks a direction upon the learned trial court to conclude the trial within a period of six months positively and in case, the same is not concluded, it is submitted that liberty be granted to the petitioner to approach this Court for grant of bail. Liberty, so sought, is granted. 4.

It is needless to state that the learned Court of Additional Sessions Judge-V, Danapur, District-Patna, in connection with Session Trial No. 150 of 2021, arising out of Sigori P.S. Case No. 94 of 2019, shall definitely conclude the trial within a period of six months from today, as had also been directed, vide order dated 17.10.2023, with intimation to the Registrar General of this Court.

Accordingly, the present petition stands disposed off on
