The petitioner apprehends his arrest in connection with Jhajha P.S. Case no. 139 of 2018, registered under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.

The accusation is that on 23.04.2018 at about 10.00 P.M. while informant Baruna Devi was sitting at her door in the meantime, Shivam aged about 8 years threw stone towards the informant. Thereafter, informant went to make complain to his parents, but his parents started abusing her, when informant made protest then this petitioner caused injury through iron rod causing grievous injury. In the meantime, wife of the petitioner, namely, Manisha Devi and son Saurav came

Patna High Court Cr.Misc. No.50012 of 2018(2) dt.20-09-2018 2/2 there and started assaulting to the informant with bamboo stick as a result whereof, informant became unconscious and fell down.

Learned counsel for the petitioner submits that petitioner does the work of Guard at Patna in Pushpanjali Hospital. Further submission is that, in fact, quarrel took place in between the ladies of the informant and petitioner on the issue of the childish behaviour, but informant implicated the petitioner making allegation of causing injury by means of axe, but only one injury was found on the person of the informant, which is of lacerated on the scalp. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Jamui in connection with Jhajha P.S. Case No. 139 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
