JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-12-2018 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Mohiuddin Nagar P.S. Case No. 36 of 2018 for the offence under Sections 341, 342, 325, 376/511 of the Indian Penal Code. Having regard to the allegation levelled against the petitioner by the prosecutrix, the Court is not inclined to grant privilege of anticipatory bail. Accordingly, the prayer for grant of anticipatory bail is rejected.

In the event, the petitioner surrenders before the court below and prays for regular bail, the court below is directed to dispose of the application for grant of bail on the same day on its own merit without being influenced by the rejection of anticipatory bail application by this Court.
