In this case, the petitioner is seeking anticipatory bail in connection with Bakhtiyarpur P.S. Case No. 387 of 2018 registered for offence punishable under sections 341, 323, 337, 338, 307, 379/34 of the Indian Penal Code.

As per the allegation, on 28.07.2018 while the nephew of informant was returning from market, already there was mud in the lane, he wanted to cross the lane after keeping a piece of brick on mud, whereupon the accused persons started hurling abuses and stopped him to cross from there, inasmuch as, allegation has been made that they have exerted to give the pistol to kill him, whereupon Ajay Rai and Ranjeet Rai brought the pistol, fired and also snatched Rs.15,600/- from the nephew of informant, later on, they have started pelting stones and caused injury to the female and

Patna High Court CR. MISC. No.28645 of 2019(2) dt.01-05-2019 2/2 children, one child aged about eight year was badly injured. The learned counsel for the petitioner submits that there is no specific allegation against the petitioner. The dispute arose on account of lane which are being used by the accused persons and the informant.

Looking to the facts and entirety of the case, the prayer for bail of the petitioner is allowed and he, in the event of arrest or surrender before the court below within six weeks from today, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional Chief Judicial Magistrate, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 387 of 2018, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
