Petitioners apprehend their arrest in connection with Chand P.S. Case No. 105 of 2018 registered for the offence punishable under Sections 363, 365 and 366(A)/34. Petitioners are said to have kidnapped minor daughter of the informant while she had gone for defecation. It is submitted by learned counsel for the petitioners that the petitioners are quite innocent and have committed no offence. Petitioners have no concern with the aforesaid occurrence. They have been falsely implicated in this
Patna High Court CR. MISC. No.28553 of 2019(2) dt.02-05-2019 2/2 case due to dirty village politics. Victim in her statement recorded under Section 164 Cr.P.C. has candidly stated that due to spat with her mother, she had suo motu left her house for her aunt. She has not stated about kidnapping her at the hand of the petitioners. Petitioners have no criminal antecedent. On the other hand, learned APP opposed the bail prayer of the petitioners.
In the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Kaimur (Bhabua) in connection with Chand P.S. Case No. 105 of 2018 , subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
