1. Heard the parties.

2. The petitioner seeks regular bail in connection with Benipatti P. S. Case No. 19 of 2018 registered for the offences punishable under Sections 406, 409, 467, 468, 471, 420 and 34 of the IPC.

3. The main submissions advanced by the petitioner's counsel are that the petitioner is innocent and has falsely been implicated in the present case and co-accused Rambabu Yadav had stolen several cheques from the cheque book of Gram Panchayat Benipatti and by forging the signatures of the petitioner and the Mukhiya, withdrew the alleged amount and deposited the same in his own account and despite direction of this court in Cr. Misc. No. 50047 of 2018 for comparison of signatures through expert opinion, the Investigating Officer

Patna High Court CR. MISC. No.32037 of 2026(2) dt.12-05-2026 2/2 submitted chargesheet without complying with the said direction and co-accused Rambabu Yadav and Ganour Sada have already been granted bail. The petitioner has no criminal antecedent, is aged about 64 years, suffering from ailments and is in custody since 16.12.2025.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

In the facts and circumstances of this case and considering the statements made in the petition as well as above submissions, coupled with the petitioner's custody period and also the fact that similarly situated co-accused person Rambabu Yadav has been granted bail and also taking into account the completion of investigation against him, this court is inclined to enlarge the petitioner on bail. Accordingly, let the petitioner named-above be enlarged on bail in connection with Benipatti P. S. Case No. 19 of 2018 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
