The petitioner is languishing in custody for the offences punishable under Sections 302/307/34 of the Indian Penal Code and Section 27 of the Arms Act in connection with Ariyari (Kasar) P.S. Case No. 15 of 2020.
According to FIR, the petitioner fired causing injury and death of Pankaj Kumar as well as injury to Saroj Pandit. Saroj Pandit has supported the allegation before the police that the petitioner is assailant.
Learned counsel for the petitioner submits that the petitioner is in custody since 04.02.2020. Investigation of the case is already complete. Petitioner is ready to cooperate with the trial. In fact due to previous enmity the petitioner has
Patna High Court CR. MISC. No.29631 of 2020(4) dt.22-01-2021 2/2 falsely been implicated in this case. There is no other eyewitness of the occurrence.
Considering the nature of allegation and evidence of the injured witness of the same occurrence, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. The trial Court is directed to expedite the trial. (Birendra Kumar, J) Mkr./- U T
