The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

Total 32 liters of foreign liquor has been recovered in three cartoons from Mithilanchal Express, which was being transported from Kolkata to Sitamarhi.

Petitioner is not named in the F.I.R. and his name transpired during course of investigation only on the allegation that he is the owner of Tara Enterprises, from which, parcels were transported.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent.

Case No. 58 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
