Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has antecedent of nine cases and allegation is of recovery of 123 litres of liquor from a motorcycle. 4.
Learned counsel for the petitioner submits that petitioner came to be implicated at the instance of Chowkidar with whom he is on an inimical term and he is in custody since 1-3-2024. It is next submitted that the seized motorcycle does not belong to the petitioner and it appears that Chowkidar, with a view to save the real culprit, falsely implicated the petitioner.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 40,000/- (Rupees Forty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bhore P.S. Case No. 628 of 2023.
