Petitioners apprehend their arrest in connection with Special Case No. 3874 of 2017, arising out of Maner P.S.Case No. 320 of 2017, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation against the petitioners is of recovery of 110 litres of country made wine from their houses. Submission of learned counsel for the petitioners is that recovery has not been made from the house, rather from the pig room which is outside the house and petitioners have falsely been implicated in this case and they have no criminal antecedent. Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.51240 of 2018 (2) dt.12-09-2018 2/2 circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Special Case No. 3874 of 2017, arising out of Maner P.S.Case No. 320 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
