JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 22-06-2023 Heard learned counsel appearing on behalf of the petitioners and learned counsel appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioners seek bail in connection with Bhaptiyahi P.S. Case No. 125 of 2022 registered for the offence under Section 304B and 34 of the Indian Penal Code. The accused/petitioners are named in the F.I.R. and are in custody since 02.01.2023.

No.31882 of 2023(2) dt.22-06-2023 2/3 The allegation against petitioners is to cause death of the daughter of informant alongwith other co-accused persons/family members due to non-fulfillment of demand of dowry as raised for unexplained cash and kind. Learned counsel appearing on behalf of the petitioners submitted that petitioners are in-laws and living separately and they have been falsely implicated with the present case only being parents of the husband of deceased, who is already in custody in connection with present case. While concluding the argument, it is submitted that petitioners are of clean antecedents and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence. Learned APP, opposes the prayer of bail.
Considering the facts and circumstances as mentioned above, as both petitioners are in laws, appears to live separately, coupled with the fact that charge-sheet has already been submitted, where petitioners are in custody since 02.01.2023 accordingly, petitioners above named, are directed to be released on bail in connection with Bhaptiyahi P.S. Case No. 125 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction
