Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Chhatapur (Rajeshwari OP) P.S. Case No. 310 of 2019, disclosing offence punishable under Sections 3/7 of the Essential Commodities Act, 1955.

The petitioner is in custody since 25.02.2021. The FIR has been registered on the basis of a written report of the Block Supply Officer, Chhatapur (Araria) on the allegation of recovery of 12.50 quintals of wheat from the possession of co-

Patna High Court CR. MISC. No.41272 of 2021(3) dt.06-01-2022 2/2 accused Mithlesh Chaupal. The petitioner is the Manager of concerned PACS. It is alleged against him that he had surreptitiously supplied the said food-grain to co-accused Mithlesh Chaupal.

Learned counsel appearing on behalf of the petitioner has submitted that said Mithlesh Chaupal has been allowed regular bail by this court by an order dated 25.08.2020, passed in Cr. Misc. No. 21448 of 2020. He has further submitted that considering the nature of accusation, there is no likelihood of tampering with the evidence, if the petitioner is allowed privilege of regular bail.

Considering the fact that co-accused Mithlesh Chaupal has been allowed regular bail by this Court and the petitioner is in custody since 25.02.2021, this application is allowed.

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned S.D.J.M., Supaul, in Chhatapur (Rajeshwari OP) P.S. Case No. 310 of 2019.
