The appeal is admitted.

In this appeal, the appellants are seeking anticipatory bail in connection with Sonpur P.S. Case No. 420 of 2020 registered for offence punishable under sections 147, 148, 149, 341, 323, 324, 337, 338, 307, 379, 427, 504 of the Indian Penal Code and sections 3 (i) (r) (s) of the SC/ST (POA) Act. There is specific allegation against the appellant nos. 1

Patna High Court CR. APP (SJ) No.2111 of 2020(2) dt.09-02-2021 2/2 and 2 to involve in assaulting the victim but there is no direct allegation made against appellant nos. 3, 4 and 5, who are lady. In such view of the matter, the prayer for bail of appellant nos. 1 and 2 is rejected and the prayer for bail of appellant nos. 3, 4 and 5 is allowed. The impugned order dated 04.07.2020 is set aside.

Let the above named appellant nos. 3, 4 and 5, in the event of arrest or surrender before the court below within six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of 1st Additional District and Sessions Judge-cum-Special Judge, SC/ST, Saran at Chapra in connection with Sonpur P.S. Case No. 420 of 2020, subject to condition that one of the bailors of the appellants shall be their close relative.
