In the present writ application, the petitioner has prayed for issuance of writ of certiorari for quashing order dated 21.03.2013 passed in Land Dispute Case No.111 of 2012-13 by the DCLR, Nemchak Bathani, Khinjarsarai by which the DCLR has directed the petitioner to remove his title possession over the land in question within 30 days failing which the same would be removed with the help of local police.
3. It is interesting to note that this writ is pending for the last almost 12 years but neither the State of Bihar nor its any
Patna High Court CWJC No.19910 of 2013(5) dt.02-07-2025 2/2 functionary are parties in the present writ application. Manifestly, the writ application is not maintainable. Learned counsel for the petitioner submits that he is ready to withdraw the present writ application with liberty to pursue alternative remedy before appropriate forum/authority/Court.
4. As prayed for by learned counsel for the petitioner, this writ application is dismissed as withdrawn with liberty to the petitioner to approach appropriate forum/authority/Court as may be available to the petitioner in law.
5. This writ application is dismissed as withdrawn with the aforesaid liberty granted.
