Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Barhara P.S. Case No.758 of 2022 dated 03.11.2022 registered for the offence(s) punishable under Section(s) 147, 148, 149, 323, 325, 341, 504, 506, 307 and 302 of the Indian Penal Code.

The main submissions advanced by the learned counsel for the petitioner are that in the present matter seven persons including this petitioner have been named in the FIR and out of them one co-accused namely Siddheshwar Singh @ Nanhak Singh has been granted bail by a co-ordinate Bench of this Court vide order passed in Cr. Misc. No.18727 of 2023 and against the petitioner there is no specific allegation in the

Patna High Court CR. MISC. No.32729 of 2023(2) dt.05-07-2023 2/2 FIR and she and other co-accused persons were alleged to have assaulted the prosecution party by means of lathi, danda, and iron rod. Further submissions are that the petitioner is an old lady and has been languishing in jail since 22.03.2023 and both the sides are relatives.

Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and mainly the petitioner's old age, as stated above, and his custody period and also the fact that in the FIR there is no specific allegation against her and one similarly situated co-accused person mentioned above is on bail, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail in connection with Barhara P.S. Case No.758 of 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) sangam/- U T
