2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 419, 420, 504 and 506/34 of the Indian Penal Code.

3. As per the FIR, informant was working as Contractor in the Bajaj Electric Company and petitioner was working as Engineer. During their employment at Bajaj Company, the informant took Rs. 7,30,000/- credit from the petitioner and made out agreement on stamp paper. The informant returned the money after few days, but the petitioner did not return the agreement paper. Besides, the petitioner took one XUV 500 Mahindra Car having registration No. BR-21-P3720 and hydrolic tractor bearing registration no. BR-21-GA-

Patna High Court CR. MISC. No.32954 of 2023(2) dt.24-07-2023 2/3 4997 of the informant, but on repeated request made by the informant, the petitioner did not return the agreement paper and vehicles.

4. It is submitted that petitioner has been falsely implicated in this case due to enmity. The entire allegation is false and concocted. It is further submitted that petitioner is an Engineer in Bajaj Electric Company whose allocation of work is whole Madhubani District for rural electrification work. Informant is Contractor in the company, whose work was not found satisfactory hence, he was not given further work, in revenge he filed this false case. Moreover, the alleged occurrence took place on 04.02.2021 and the FIR was lodged on 12.02.2022 after lapse of one year. There is no chit of paper in support of the allegation. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Bisfi P.S. Case No. 27 of 2022, subject to the
