The petitioner seeks bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.

In pursuance to the order dated 22.06.2022, status report of trial in connection with Sessions Trial No. 175 of 2020 arising out of Hilsa P.S. Case No. 606 of 2019 has been received and kept at Flag-A, in which it is reported that charge has been framed in this case on 27.07.2021 and summons has been issued against prosecution witnesses. The case is fixed at the stage of evidence of prosecution and the next date fixed in this case is on 12.07.2022. It is further reported that presently the court is lying vacant as presiding officer has been transferred, therefore, the progression of trial is not possible in vacant court. Accordingly, his payer for bail is rejected in connection with Sessions Trial No. 175 of 2020 arising out of Hilsa P.S. Case No. 606 of 2019. Accordingly, the application is dismissed. However, Trial Court is directed to conclude the trial as expeditiously as possible within a period of nine months. If the trial is not concluded within the stipulated period, petitioner is at liberty to renew his prayer for bail.
