KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 29-11-2021 Petitioner has prayed for the following relief(s):- "(I) For issuance of an appropriate writ/writs or a direction to the respondents to quash and set aside the order dated 25.04.2020 contained in Memo No. 233, issued by the Respondent Sub Divisional Officer, Barsoi, Katihar, whereby and where under the Respondent has been pleased to suspend the License No. 05/93 Public Distribution System License of petitioner, without any rhyme and reason and even without any show cause notice.

Patna High Court CWJC No.7964 of 2020(2) dt.29-11-2021 2/3 The shop has been suspended on the basis of an Enquiry report by which an allegation that Stock Punji, Vitran Punji, Sandharit (Maintained) Nahi hai Vitran Punji me antar paya gaya and for that a recommendation was made to lodge an F.I.R.

The District Magistrate, Katihar on 24.04.2020 vide Memo No. 235 directed to the Block Supply Officer, Balrampur to needful and on very next date i.e. on 25.04.2020 after lodging an F.I.R. suspended the License of petitioner.

(II) For issuance of an appropriate direction to the respondents to quash the show cause notice dated 05.08.2020 contained in Memo No. 596 issued by the respondent Sub Divisional Officer, Barsoi by which suspending license, aforesaid on 25.04.2020 after more than 90 days, i.e. on 05.08.2020 as to why has license be not cancelled.

(III) For issuance of an appropriate writ or a direction to Restore the Public Distribution System License No. 05/93 aforesaid, as without any show cause notice and on flimsy ground license has been suspended.

(IV) For any other relief/reliefs for which the petitioner is entitled to get."

Learned counsel for the petitioner seeks permission to withdraw the petition.

Prayer allowed.

The petition is disposed of as withdrawn.
