JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-09-2023 The present petition has been filed for restoring a writ petition bearing C.W.J.C. no. 9132 of 2015, which has stood dismissed on account of non- prosecution by an order dated 27.03.2023, passed by this Court in the aforesaid writ petition.

The learned counsel for the petitioner has submitted that on account of change in the Advocate-on-Record, the earlier counsel did not appear in the aforesaid writ petition, on the day the aforesaid writ petition was called out for hearing, however now the present counsel, who has filed the present petition for restoration, has been authorized to appear in the said writ petition, hence a sympathetic view be taken and the aforesaid writ petition be restored to its original file. Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel

Patna High Court MJC No.1352 of 2023(2) dt.01-09-2023 3/3 for the petitioner as also taking into account the averments made in the present petition, I deem it fit and appropriate to restore the aforesaid writ petition bearing C.W.J.C. no. 9132 of 2015 to its original file.
