Mr.Mukesh Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-01-2022 Heard learned counsel for the petitioner and the State. The matter has been taken up through video conferencing.

Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, four unknown miscreants in a conspiracy with this petitioner and others made indiscriminate firing on the son of informant, Shakti Singh, and also hurled bomb due to which Shakti Singh died in course of treatment.

Learned counsel appearing for the petitioner submits that petitioner has been made accused in this case only on

Patna High Court CR. MISC. No.41206 of 2021(2) dt.17-01-2022 2/2 suspicion due to rivalry between the Shankar Prasad and the informant for claiming management work of SKG Sugar Mill. Similarly situated accused Md. Ehashan has already been granted bail by this court vide order dated 07.01.2022 passed in Cr. Misc. No. 37615/ 2021 . Petitioner claims clean antecedent and is in custody since 08.01.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate (XVI), Gopalganj in connection with Mirganj PS case No.08/2021.
