This is an application for grant of anticipatory bail in connection with Warisaliganj P.S. Case No. 172 of 2018 registered for the offence punishable under Sections 147, 149, 341, 323, 427, 283, 332, 333, 353 and 504 of the Indian Penal Code.
The case of the prosecution is that the villagers had put up a road blockade on account of death of one Deonandan Prasad and when the Police had gone for removing the road blockade, the accused persons including the petitioner herein had engaged in scuffle with he police personnel.
The learned counsel for the petitioner submits that there is a general and omnibus allegation and no specific allegation has been levelled as against the petitioner herein. It is further
Patna High Court Cr.Misc. No.51644 of 2018 (2) dt.08-10-2018 2/2 submitted that the petitioner is having a clean antecedent and he is ready to abide by whatever condition this Court may deem fit and proper to be imposed.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named on anticipatory bail, subject to the petitioner depositing a sum of Rs. 15,000/- (fifteen thousand) before the Nazarat of the court below. Accordingly, the petitioner above named is granted liberty to deposit a sum of Rs. 15,000/- (Rs. fifteen thousand) before the Nazarat of the court below within a period of four weeks from today and upon showing receipt of deposit of the said amount, the learned A.C.J.M.-II, Nawada shall enlarge the petitioner above named, in the event of his arrest or surrender before the court below, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Warisaliganj P.S. Case No. 172 of 2018 subject to such other conditions as the learned court below may deem fit and proper to be imposed upon the petitioner herein. The bail application is disposed of.
