JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-03-2021 Though the present petition has been filed for quashing the order dated 22.06.2020 passed in Matrimonial Case No. 351 of 2019, by the learned Court of Principal Judge, Family Court, Rohtas, by which the learned court below has adjourned the matter, however has imposed a fine of Rs. 5,000/-, but the learned counsel for the petitioner has made a short submission to the effect that the order dated 22.06.2020 may not be interfered with, nonetheless, considering the fact that on account of the COVID-19 Pandemic situation, the petitioner was precluded from appearing before the learned court below, necessitating a prayer being made for an adjournment, the fine of Rs. 5,000/- be waived.
At this juncture, the learned counsel for the petitioner
Patna High Court C.Misc. No.512 of 2020(2) dt.26-03-2021 2/2 submits that the evidence has already been closed and the matter is fixed for arguments.
Having regard to the facts and circumstances of the case and considering the prevailing situation on account of COVID-19 Pandemic, I deem it fit and proper to waive the cost of Rs. 5,000/- imposed by the learned court below upon the petitioner in the pending Matrimonial Case No. 351 of 2019, vide order dated 22.06.2020, with a direction to the learned Court of Principal Judge, Family Court, Rohtas to finally decide the aforesaid Matrimonial Case No. 351 of 2019 forthwith, in view of the observation of the Hon'ble Apex Court in its order dated 30.08.2019 passed in Transfer Petition (Civil) No. 1524 of 2018.
The petition stands disposed off on the aforesaid terms.
