2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code.

3. Informant's daughter was married with this petitioner 12 years back. Out of the wedlock, they had three children. On 18.2.2024 she was hanged to death by the petitioner and his family members.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case because he is husband of the deceased. By filing supplementary affidavit, learned counsel submits that during trial of the case Sessions Trial No. 733 of 2024, PW-1 namely Sunil Rai who is the brother of the deceased Sima Devi, PW- 2 namely Pramod Kumar who is the cousin brother of the

No.29500 of 2025(4) dt.26-09-2025 2/2 deceased Sima Devi and PW-3 namely Indu Devi who is the informant and mother of the deceased Sima Devi, have not supported the prosecution case. They have stated that due to illness, the deceased Sima Devi died and they had taken part in her funeral. Petitioner is in custody since 19.2.2024.

5. Learned counsel for the State opposes the prayer for bail.

Considering the aforesaid depositions of prosecution witnesses and custody of the petitioner, let the petitioner as mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the District and Additional Sessions Judge XII, Vaishali at Hajipur in Sessions Trial No. 733 of 2024, Vaishali Police Station Case No. 61/2024.
