2. The petitioner has preferred this application for grant of regular bail in connection with Garkha P.S. Case No. 79 of 2026 dated 24.01.2026 registered for the offences punishable under Sections 103(1), 238(a), 61(2) and 303(2) of B.N.S.

3. The prosecution case, in brief, is that the petitioner along with other co-accused persons took away the informant's brother. When he failed to return that night, a search was conducted, and the informant subsequently learned that a dead body, which was later on identified as the informant's brother, was lying near a ditch.

4. Learned counsel for the petitioner has submitted that from the perusal of the FIR, it is clear that it is a case of last

Patna High Court CR. MISC. No.30316 of 2026(3) dt.24-06-2026 2/3 seen. It has further been submitted that there is no eye-witness to the alleged occurrence of murder. It has further been submitted that during the course of investigation, it emerged that the deceased had an illicit relationship with the sister of one Mithai Ram, consequently Mithai Ram was unhappy with the relationship. Learned counsel for the petitioner has further submitted that from perusal of the post-mortem report, it is clear that the doctor who conducted autopsy of the deceased, has opined the cause of death to be drowning. But from perusal of the post-mortem report, it is clear that two ligature marks were also present on the front of neck of the deceased. Save and except ligature mark, no external injury was found on the person of the deceased.

It has further been submitted that there is general and omnibus allegation against the petitioner and except confessional statement, nothing is against the petitioner. It has further been submitted that similarly situated co-accused persons, namely Rakesh Kumar and Vikash Ram, have been extended the privilege of bail by Co-ordinate Bench of this Court by order dated 14.05.2026 passed in Cr. Misc. No. 32987 of 2026. It has further been submitted that petitioner is in custody since 25.01.2026 and has got no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

6. Heard learned counsel for the parties and perused the records.

7. Considering the entire facts and circumstances of the case as well as the parity, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saran at Chapra in connection with Garkha P.S. Case No. 79 of 2026.

8. The application stands allowed.
