Learned counsel appearing for the petitioners fairly submits that in view of the statement made in para-12 of the counter affidavit filed by the Respondents No. 4 to 7 wherein it has been stated that an appeal vide Land Encroachment Appeal No. 02/2014 has been preferred by the petitioners before the
Patna High Court CWJC No.6220 of 2016(4) dt.03-07-2025 2/2 Respondents No.4 which is still pending for hearing and Title Suit No. 07/2014 has also been filed on behalf of the petitioners which is pending in the court of learned Sub-Judge- 1, Biharsharif, the petitioners do not wish to press the present writ application.
3. As prayed for by the learned counsel for the petitioners, the present writ application is dismissed for non prosecution.
