2. In the present case, the petitioner seeks bail in connection with Buxar (M) P.S. Case No. 258 of 2023, dated 02.06.2023, registered for the offence punishable under Section 392 of the B.N.S., 2023.
3. As per the prosecution case, unknown miscreants surrounded the vehicle of the informant and snatched his vehicle and threatened him with lathi. They also snatched wallet of the informant, a gold chain and cash of rupees one thousand four hundred and fifty. The name of the petitioner transpired during investigation for being involved in the said offence.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely

Nothing incriminating has been recovered from person or possession of this petitioner who has not been put on test identification parade till date. The name of the petitioner sprung up in this case on the basis of confessional statement of the co-accused Mohan Chauhan, but the said confessional statement has got no legal sanctity. Learned counsel further submits that similarly placed coaccused person, namely Ravi Shankar Rajbhar has been granted regular bail by a learned co-ordinate Bench of this Court vide order dated 26.02.2024 passed in Cr. Misc. No. 11773 of 2024. Learned counsel next submits that petitioner is having antecedent of one case and chargesheet has been submitted. Learned counsel lastly submits that petitioner is in custody since 30.01.2026.
5. Learned A.P.P. appearing on behalf of the State opposes the submissions made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the vague nature of allegation of petitioner, his period of custody and submission of chargesheet and also considering the grant of bail to similarly placed co-accused, the petitioner, above-named, is directed to be released on bail, on furnishing bail bonds of
Patna High Court CR. MISC. No.30398 of 2026(2) dt.11-05-2026 3/3 Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar / concerned Court, in connection with Buxar (M) P.S. Case No. 258 of 2023, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial Court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the Court concerned. (Arun Kumar Jha, J) Shahnawaz/- U T
