2. The petitioner seeks bail in connection with Mirganj P.S. Case No. 82 of 2024 instituted for the offences under Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. Prosecution case relates to recovery of one mobile phone from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on suspicion. No any arms and ammunition has been recovered from his conscious possession. Petitioner has no concern with the alleged recovery. Charge-sheet has been submitted in this case. The petitioner is

Patna High Court CR. MISC. No.33213 of 2024(2) dt.01-05-2024 2/2 in judicial custody since 06.03.2024. There is no compliance of Section 100 of Cr.P.C.

5. Learned A.P.P. for the State has vehemently opposed the prayed for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case and the period of custody of the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the Court below/concern Court in connection with Mirganj P.S. Case No. 82 of 2024.
