2. Petitioner seeks bail who is in custody since 10.07.2025 in connection with Rajeev Nagar P.S. Case No. 274 of 2023 for the offences punishable under Sections 341, 342, 323, 325, 324, 307, 504 and 34 of IPC.

The case of the prosecution, in brief, is that one Subodh Kumar is the informant of this case and he has given his written statement before the Station House Officer of Rajeev Nagas Police Station on 17.05.2023 which is as follows:- (a) That the informant is a resident of village- Choti Bagicha Road No. 21. Rajeev Nagar Patna and on 15.05.2023 at 10.30 p.m number of persons used to come at the house of Chunni Devi and they parked their motorcycle at the house of the informant and when the informant instructed them not to park the motorcycle then one Chunni Devi called him bad names and

2/4 thereafter her sons namely Vijay Kumar, Ajay Kumar started to call him bad names and assaulted him with Lathi and Rod by which he sustained injury on his head and fall down and when his brother Tunnu Singh came to save him then Chunni Devi called Raushan Kumar, Karan, Sunny, Laghu, Suraj @ Garashi and they came holding the Lathi Danda and rod and started to assault his brother Tunnu Singh and broken both the legs of his brother Tunnu Singh and he was admitted in PMCH and the information was not transmitted to police because both the brothers were injured and thereafter he has given his written statement on 17.05.2023 and requested to take legal action against the accused persons and on such the instant F.I.R. was lodged.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. It is further submitted that the allegation as alleged in the FIR is forged and fabricated and the petitioner has not committed any offence as alleged in the FIR. It is next submitted that the FIR is in two parts, in first part, there is direct and specific allegation attributed against the co-accused persons, namely, Vijay Kumar and Ajay Kumar and in second part, there is general and omnibus allegation against all the accused persons including the

It is next submitted that the co-accused persons, namely, Chunni Devi and two others have been granted bail by a Coordinate Bench of this Court vide order dated 29.02.2024 passed in Cr. Misc. No. 73781 of 2023, another co-accused person, namely, Raushan Kumar has been granted bail by a Coordinate Bench of this Court vide order dated 29.02.2024 passed in Cr. Misc. No. 7922 of 2024 and another co-accused person, namely, Suraj Kumar @ Gadasi has been granted bail by a Coordinate Bench of this Court vide order dated 10.04.2024 passed in Cr. Misc. No. 26832 of 2024 and petitioner is in custody since 10.07.2025.

5. The learned Additional Public Prosecutor for State has vehemently opposed the prayer for bail of the petitioner and submits that petitioner has antecedent of four cases other than the present case but fairly submits that petitioner is on bail in the pending matters.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJMII, Patna in connection with Rajeev Nagar P.S. Case No. 274 of 2023, subject to the following conditions:-

Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
