2. The petitioner seeks regular bail in connection with Baligaon P.S. Case No. 62 of 2023, lodged on 02.06.2023, for the offences punishable under Sections 376(D) & 328/34 of the Indian Penal Code and under Section 6 of the POCSO Act, pending before the Court of the District and Sessions Judge-VIcum-Spl. Judge, POCSO, Vaishali at Hajipur.
3. Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 26.04.2024 passed in Cr. Misc. No. 17437 of 2024.

4. Counsel further submits that the petitioner is innocent and has unnecessarily been made an accused in the present case. Counsel further repeats almost the same statements as in the earlier rejection order and submits that the petitioner has been in custody since 03.06.2023. Counsel further submits that out of twelve charge-sheeted witnesses, nine prosecution witnesses have been examined.

Learned APP for the State opposes the prayer for bail and submits that in the earlier rejection order it has been categorically observed that the victim herself, under Section 164 of the Cr.P.C., has made specific allegations against the five named accused persons, including the present petitioner.
6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.
