2. The petitioner has prayed for bail in connection with GRP Patliputra Rail P.S. Case No.48 of 2025 registered for the offence punishable under Sections 103(1), 238(a), 3(5) of the BNS.

3. The case of the prosecution, in short, is that the body of the brother of the informant was found lying on the railway track. The informant suspects that Ranjeet Bind, Ajay Bind and Rajesh Bind have killed his brother.

4. Learned counsel appearing on behalf of the petitioner has submitted that during course of investigation the informant has not named this petitioner, whereas co-accused Ranjeet has named this petitioner. During course of investigation it has also come that the petitioner along with others and that deceased were having drink. Learned counsel for the petitioner

Patna High Court CR. MISC. No.31062 of 2026(2) dt.11-05-2026 2/2 has submitted that save and except the confessional statement of the co-accused, there is nothing against the petitioner and even from the confessional statement the role which has been attributed to the petitioner is that he was also seen with the accused persons. Learned counsel for the petitioner has further submitted that the petitioner is having no criminal antecedent and he is in judicial custody since 08.07.2025.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the court of learned Railway Judicial Magistrate, Patna Junction, Patna in connection with GRP Patliputra Rail P.S.
