JUSTICE SUDHIR SINGH ORAL ORDER 05-10-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner is apprehending his arrest in a case registered under Sections 341, 323, 324, 307, 504, 379 and 34 of the Indian Penal Code.

The prosecution case, in short, is that accused persons including the petitioner surrounded the family of the informant and assaulted them.

The earlier bail application of the petitioner for grant of anticipatory bail was rejected vide Annexure-1 to the present application.

After some arguments, learned counsel for the petitioner seeks permission of this Court to withdraw the present application with a liberty to approach the Court below for

Patna High Court Cr.Misc. No.52110 of 2018(2) dt.05-10-2018 2/2 regular bail.

Permission is accorded.

The present application stands disposed of with the aforesaid liberty.

If the petitioner surrenders and files regular bail in the Court below, the same shall be considered on its own merit without being prejudiced by this order.
