2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. On account of preexisting land dispute, it is alleged that the accused persons along with these petitioners made indiscriminate firing upon the husband of the informant.
4. Learned counsel for the petitioners submits that these petitioners have falsely been implicated in this case on account of preexisting land dispute. Allegation of firing is
Patna High Court CR. MISC. No.31867 of 2023(2) dt.20-07-2023 2/2 general and omnibus in nature. Police after investigation submitted the final form. Similarly situated co-accused has been granted bail by the Bench of this Court vide order dated 07.07.2023 passed in Cr. Misc. No.27087 of 2023.
5. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the J.M. 1st class, Saran at Chapra, in connection with Khaira P.S. Case No. 172 of 2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Alok Verma/- U T
