JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 This application, for grant of anticipatory bail, arises out of Sare P.S. Case No. 147 of 2018, disclosing offences under Sections 363 and 365 of the Indian Penal Code. Allegation against the petitioner and other accused persons is of kidnapping the minor daughter of the informant. Submission of learned counsel for the petitioner is that he has falsely been made accused in this case and the statement of girl recorded under Section 164 Cr.P.C. disclosed that she had gone with one Bablu out of her own sweet will and she admitted that she is in love affair with the said Babloo and want to marry him. Further submission is that the girl in her statement under Section 164 Cr.P.C. disclosed her age as 19 years and the court below has also assessed her age as 18 years. Learned counsel for the State opposed the prayer for

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Nalanda at Biharsharif, in connection with Sare P.S. Case No. 147 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
