08-05-2019 Heard Sri Jainendra Kumar, learned counsel for the petitioner and Sri Sanjay Kumar Singh, learned Addl. Public Prosecutor.

Within short span of time, the petitioner has renewed his prayer for bail in Birupur P.S. Case No. 6 of 2018 registered for the offence under Sections 394/412 of the Indian Penal Code. On 05-09-2018, the prayer for bail of the petitioner was rejected vide Cr. Misc. No. 48861 of 2018, considering the fact that the petitioner was apprehended while he was fleeing away after committing robbery.

Sri Jainendra Kumar, learned counsel for the petitioner, in presence of Sri Sanjay Kumar Singh, learned Addl. Public Prosecutor, submits that despite the fact that during trial,

Patna High Court CR. MISC. No.29551 of 2019(2) dt.08-05-2019 2/2 some of the prosecution witnesses have been examined, they had not supported the prosecution case and, as such, he makes a prayer for grant of bail.

The Court is of the opinion that since evidence has already commenced, it would not be advisable to pass favourable order. The prayer for grant of bail again stands dismissed.

However, considering the fact that trial is going on, it is desirable to observe that the learned trial court may take appropriate steps, so that the case may come to its logical end without unnecessary delay.
