JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-09-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 394 of Indian Penal Code. As per prosecution case, 5 unknown persons forcibly got down the informant from his motorcycle and snatched away his mobile and other valuable items.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that petitioner is not named in the FIR and no incriminating material has been recovered from the conscious possession of the petitioner. Except the confessional statement of the co-accused persons, there is no material to indicate complicity of the petitioner in the aforesaid case.
Considering the aforesaid facts and circumstances, let
Patna High Court CR. MISC. No.29904 of 2022(2) dt.29-09-2022 2/2 the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in Suppi P. S. Case No. 22 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
