Petitioner apprehends his arrest in Buxar (Town) P.S. Case No.750 of 2018, registered under Sections 366A and 120(b) of the Indian Penal Code.

The mother of the victim disclosed that she woke up in the night but she did not find her daughter inside the house. On enquiry from the parents of Durgesh Ram, she came to know that Durgesh Ram kidnapped her minor daughter for the purpose of marriage.

Learned counsel for the petitioner submits that the victim is a major girl. She disclosed her age to be 18 years in her statement recorded under Section 164 Cr.P.C. and she also denied the factum of her kidnapping. She disclosed that she

Patna High Court CR. MISC. No.30631 of 2019(2) dt.09-05-2019 2/2 voluntarily left her house and went along with Durgesh Ram. Later on she solemnized marriage and she was willing to live with her husband Durgesh Ram.

Taking into consideration the fact that the victim herself denied the factum of her kidnapping, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Buxar (Town) P.S.
