JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 324, 354, 307, 504, 506, 326/34 of the Indian Penal Code, Section 8 of the POCSO Act.

On the alleged date and time of occurrence accused Rajik Hasan along with three to four friends armed with weapons abused and inflicted knife blow on the informant with intention to kill her.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. The name of the petitioner surfaced during investigation on the confessional statement of the co-accused Rajik Hassan. The specific and direct allegation is against co-accused Rajik Hassan, who is alleged to have abused

Patna High Court CR. MISC. No.31708 of 2023(2) dt.14-07-2023 2/2 and inflicted repeated knife blow on the informant. Petitioner claims clean antecedent.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge (POCSO) Gopalganj in connection with Manjhagarh P.S.
