ANJANA MISHRA ORAL ORDER 29-08-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Hussainganj P.S. Case No.200 of 2014 for allegedly having committed the offence under Sections 304B and 201/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are father-in-law, brother-in-law, sister-in-law and mother-in-law of the deceased lady.
Learned counsel for the petitioners has renewed the prayer for anticipatory bail on the premise that the husband had
Patna High Court Cr.Misc. No.50588 of 2018 (2) dt.29-08-2018 2/2 been taken into custody and after trial, he has been acquitted of the charges. Learned counsel for the petitioners has brought on record the judgment (Annexure-3) which indicates that Bharat Ram, S/o Chandeshwar Ram (Petitioner No.1 herein), has since been acquitted from the charges under Section 304B and 201/34 I.P.C.
In view of such changed situation, let all the four petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Hussainganj P.S. Case No.200 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
