2. Petitioner seeks bail, who is in custody since 03.09.2025, in connection with Magadh University P.S. Case No. 201 of 2025, F.I.R. dated 02.09.2025 registered for the offences punishable under Sections 65(1), 329(4)of the B.N.S., 2023 and Sections 4 and 6 of the POCSO Act.

3. Allegation against the petitioner is that he has committed rape with the deaf and dumb daughter of the informant.

4. Learned counsel for the petitioner submits that

He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offence as alleged in the F.I.R.

Learned APP for the State, on the other hand, vehemently opposed the prayer for bail of the petitioner and submits that as per allegation in the F.I.R. the petitioner has committed rape with the deaf and dumb daughter of the informant and the age of the victim is 11 to 12 years on the date of occurrence and apart from that a number of witnesses have supported the case of the prosecution and medical report also confirms that the petitioner has committed wrong with the victim.

6. Considering the nature of allegation against the petitioner supported by the medical evidence, I am not inclined to enlarge the petitioner on bail in connection with Magadh University P.S. Case No. 201 of 2025 pending in the Court of learned A.D.J. VIth cum Special Judge POCSO Act, Gayaji

7. Prayer is refused.
