2. The petitioner seeks bail in Roh P.S. Case No. 413 of 2025 registered for the offences punishable under Sections 190, 191(2), 191(3), 126, 115 (2), 118(1), 118(2), 117 (2), 117(4), 109, 74, 303(2), 352, 351(2) of BNS, 2023 and under Section 103(2) BNS, 2023 and later on Section 302 IPC was added.

3. The FIR was lodged with the allegation that the husband of the informant was killed making false allegation of theft. The FIR has been lodged against 10 persons. Thereafter during investigation the name of the petitioner transpired in the case.

4. Learned Counsel for the informant draws the attention of this Court to Para 119 of the case diary mentioned in the impugned order. He submits that the petitioner is named in that viral video of dying declaration of the deceased.

5. Learned counsel for the petitioner opposes the same and states that the deceased has named three persons and the petitioner is one of them.

6. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner.

7. Considering that the petitioner is not named in the FIR and the petitioner is in custody since 13.12.2025 having no criminal antecedent, this Court is inclined to grant bail to the petitioner.

8. Let the petitioner, above named, be released on bail after verification of para 119 of the case diary on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class/concerned court, Nawada in connection with Roh P.S. Case No. 413 of 2025, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure / Section

9. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.

10. The trial court before releasing the petitioner shall verify from Para 119 of the case diary as to whether the name of the petitioner is there and if the name of the petitioner is there, his bail bond shall not be accepted.
