2. The petitioner seeks pre-arrest bail in connection with Complaint Case No. 182C2/2022 registered for the offence punishable under Sections 26, 33, 41, 42 and 52 of the Indian Forest Act and Sections 17A and 29 of the Wild Life Protection Act (Bihar Amendment 2002).

3. As per the prosecution case, a tractor bearing registration no. BR46G2427 laden with forest produce was seized. The petitioner is said to be the owner of the said tractor.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and he has committed no offence as alleged. He further submits that the

Patna High Court CR. MISC. No.32195 of 2023(2) dt.21-07-2023 2/2 District Magistrate has already initiated with the confiscation proceeding of the seized vehicles along with the forest produce. Petitioner is the owner of the said tractor. Petitioner has clean antecedent.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the fact that the tractor involved in the transportation of the forest goods have already been confiscated, the petitioner, above named, is directed to be released on prearrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Jamui in connection with Complaint Case No. 182-C2/2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
