JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. It would appear from perusal of the first information report as well as statements of witnesses that petitioner had illicit relation with one Chunni Khatoon who happens to be wife of brother of the petitioner and furthermore, it would appear that due to above stated so-called illicit relation, the relation between deceased and petitioner was strained. No doubt, petitioner happens to be husband of the deceased but after investigation, police submitted charge sheet under Sections 498 A, 302/34 of the Indian Penal Code.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that

Patna High Court Cr.Misc. No.7959 of 2014 (6) dt.02-04-2015 petitioner is in jail custody since 16.09.2013, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Paharpur P.S. Case No. 182 of 2012.
